Seller with cold feet

I am not sure this fully qualifies as sour grapes because it isn’t fully resolved yet, but I am already jaded and frustrated enough with this transaction that it probably already counts.

I found a seller with a PSA 8 1st Edition Base Mewtwo several weeks ago. To give some context, I had done business with him in the past when I bought another relatively expensive card from him, and all had gone smoothly then. We were negotiating on a price on the Mewtwo for a couple of weeks, on and off. I ended up paying basically over market at the time to try to secure the card, paying the price he wanted at the time to get the deal done. That was in late September. A week and a half goes by, and he hasn’t messaged about shipping and the card hasn’t arrived yet, so I message him politely inquiring about whether he’s been able to ship it yet. He tells me that the card is taking longer to arrive than he anticipated from his U.S. address (he’s in France and I’m also in Europe), which he hadn’t mentioned was part of the shipping before. I told him that was not an issue and waited.

After another week of silence, he messages me and tells me that the cards were sent back to the U.S. by customs, and tells me that he is going to refund me. I immediately messaged back and told him that I have some family in the U.S. that he can have the card sent to instead of refunding, and told him that I have a lot of patience and am okay to wait for that. He doesn’t reply at all, and almost a week later I get an email from PayPal saying that a refund from him didn’t complete, and doesn’t provide a reason why:

I have since messaged him a couple of times telling him that a refund is okay as well, if he could just retry it, but he hasn’t replied for nearly a week, when in the past he was quite responsive.

I have a sinking feeling that he got cold feet on the deal weeks after I sent him the money, seeing that prices were rising after I already paid him his asking price, which at the time was top dollar. In negotiations he showed a lot of signs of being hesitant to sell even at his asking price, so it wouldn’t surprise me if so. He also could be telling the truth with the customs story, but I don’t know why he would ignore my messages trying to be as understanding as possible.

It has been nearly three weeks since I gave him the money and I have neither the card nor my money back. This is all especially disheartening for me because it was the second to last card I needed to finish my PSA 8 1st ed base holo set, and now that I have since gotten the last card, this wrenches it open again. I also feel weird about trying to find another copy to buy before I get my money back, and prices are moving so quickly that I am stressed and feel like I’ll never complete my set. All in all, my grapes are very sour, I’d say. Any advice about how to handle this, or the PayPal’s refund inexplicably failed, would be greatly appreciated.

That sounds rough. :slightly_frowning_face: Given the time and lack of messages, I doubt you’ll be able to get the card from him in the end. I think he tried to refund you, and it for some reason failed (probably because he doesn’t have the money available to refund, or maybe because you have to accept it on your end and you weren’t aware/notified).

I would perhaps try to contact PayPal to ask why this refund failed, and if they can enforce the refund somehow. Explain the situation above, and mention the seller doesn’t respond anymore and this refund attempt failed for some reason, and I’m sure they’ll refund you somehow.

Good luck in your for a new PSA-8 1st ed. Mewtwo. Let’s hope you’ll get the refund asap so you’ll have the funds to buy a new one. :slightly_frowning_face:

I’m with Quuador. Just contact ebay–they will refund you quickly. In my experience they don’t take long for things such as this, or weird return cases. It has happened to me before as a buyer.

I would hop on the next 8 you see asap my friend. Get it. Get it for all of us. We’re rooting for you!

I don’t think the seller necessarily had cold feet. Him issuing the refund was the right thing to do, and while you didn’t sign up for the fact that the card would need to go through customs, he didn’t sign up for the fact that not only would it fail to go through to customs, but he’d need to put in extra work to try to get the card from customs to some new address in the U.S. which is a lot of time and effort and risk. It’s unfortunate that this didn’t work out, but at least he’s being professional and doing the refund or at least will likely help with resolving the refund situation. Anything else is asking a lot/bending over backwards to make a sale that he may not care about all that much.

I don’t think it’s actually very professional at all, he didn’t issue an actual refund as it did not complete. With a lack of communication after the fact of monetary exchange. Details left out on the purchase of the product the seller failed to mention that the product wasn’t in hand. He offered zero customer service… I don’t see the “effort” in re-printing a shipping label to a US address if the product is in the US or the “effort” in communicating to someone who just spent hundreds to thousands of dollars with you and is a return customer. It takes more effort to avoid the situation.

About a week ago the seller finally contacted me back after weeks of silence with brief message explained that from his end, the money has left his PayPal account that that I should have the money, or else I should contact PayPal support to enquire. I did so (again), and support confirmed that he cancelled the refund and that I had not received the money. I relayed all of this information in screenshots and text to the seller and have still have not heard back. I have still of course tried to assume innocence in my tone and be as polite as I can be.

I have learned a big lesson here. Even though the prior transaction went smoothly, it is very unwise to pay without buyer protection, even for someone you have prior experience with as an honorable seller. I don’t know whether the seller is intentionally scamming me at this point, or whether he really believes that his refund transaction worked and the money has left his account somehow, but I doubt at this point that I’ll ever have the money back. I don’t mean this all to sound so self-pitying and I hope to learn from this so as to avoid these situations in the future.

If you used PP goods or services you are covered by their protection policy & it sounds like you have documentation of the conversation so that is a plus in that situation. I would open a case with PP.

If you paid F&F you may be SOL…
