Seller won't accept return, help! :o

Hey, so I’m in a tricky situation, I bought a bunch of cards from someone on eBay in two different purchases, paid a ton on the cards and then another ton on import charges. The cards arrived and I checked the condition of the cards, and a lot of them were way worse than the seller had listed in the description. They even linked a guide to what they meant by the grade they said it was. And many didn’t match at all.

(There were also quite a few cards that were in very good condition.)

I told the seller that I was unhappy with some of the cards. And they apologized and said they would send new ones no problem. I said I’d look over the next purchase first when that arrived.

Then when my second purchase came I looked through everything there and there were even more cards in bad condition.(condition that didn’t match description) I told them about these cards too, then they said they had never had a complaint about the condition before and that they couldn’t give me cards that were what my opinion on what a NM or MINT card should look like.

I told them that I had read the full guide they linked to, and that’s where I looked to when checking the cards.

They said they would refund the cards, but they were on vacation for a while and would get back to me on a specific date.

I wrote to them again when they were supposedly back from vacation, they said they would try to find all the cards.

Time went and I didn’t hear from them so I wrote again, then they said sorry but they had some family issues.

Then AGAIN I had to check with them and now they said they had found some of the cards and could send them to me. Then I asked when they thought they would have the rest of the cards. Then they said they never said they would refund ALL the cards I was “unhappy” with.

I got really pissed because I had been so extremely patient with them, and now they said this. I told them that was unacceptable and that they could give me a refund if they couldn’t find all the cards. They offered a ridiculous refund. ($50 on something i paid $2200 for) I said that I would take less than 10% of the total and would accept $200.

I never heard back from them. So I decided to ask for a refund through eBay. They declined, and are not answering my messages on eBay.

It’s been over 30 days which is the limit (I think?) to ask for a refund through eBay.

Is there anything I can do or am I just screwed?

There were also fake cards and cards in the wrong language

You should try opening up a case (Item not as described). I’m not sure if it is a 30 day limit or not but it can’t hurt to try :blush:

I think that is what I tried actually, and they just closed it. I don’t know if that was because it had been 30 days or what.

File the case through eBay or PayPal item not as described. If all is as you say, you can’t lose. The deadline is like 6 months.

Just curious, you bought and were upset at the condition of an item. So you spent more money with the same seller and bought more? What’s up with that?

Lastly, paste a link to the auction here or at least the sellers username.

If you opened a case on eBay and they closed it, I believe you won’t be able to open a case on PayPal anymore either. It sounds like the seller was trying to stall you past the deadline you had to file a case. In the future, open the case asap to avoid missing the deadline. You’ll usually know from the first few responses from the seller whether or not they have any intention of actually working with you, or if they’re going to be reluctant to accept a return/partial refund.

Last resort would be to give eBay a call and explain the situation to them. Maybe they’ll help you out.

Yeah, that’s what I figure. I can’t reopen the case through eBay at least, so I wrote to eBay now and explained the situation. I’ll probably call them tomorrow. :blush: Thanks

What dates did you purchase the items?

I believe you can still open a case at least with your card company and maybe oaypal direct.

What is the deadline?

23 and 26th of August. They arrived in the beginning/middle of sept.

If they arrived at the start of last month then you really have left it late. As sok as packages come to my door I open them and check for condition because some people on ebay just font know what mint is. If you open the case right away it makes everything so much easier!

Hi, thanks @woolsluk I think you are right. I was trusting the seller when I shouldn’t have, I’ll take this as a lesson learned. eBay replied to me asking for additional info on seller and purchase etc. Then I remembered I had asked seller to mark down value on customs form, (which they didn’t btw) and I know that’s not exactly legal, so what happens if I go on and tell eBay, let them read the messages between us and they see I’ve asked for that? lol.

Haha, crap I may just have to let this seller of the hook!?

I wouldnt be too worried about that, ebay wouldn’t have the time or motive for getting you charged with avoiding import taxes,

Or if they bring up ‘lowering declared value’, just say you had no idea it wasn’t allowed and you wouldn’t have said it otherwise. Keep calling Ebay until they compensate you somehow. Don’t email them, call them and talk to reps. Ebay almost always takes the side of the buyer to keep the buyer satisfied and almost never take the sellers side, especially in cases like this.

this is a good lesson. I am always reluctant to purchase from seller abroad because returns/refunds become messy, not to mention the shipping fees alone make me think twice. i guess i am fairly lucky because I am in the US, but I know those abroad do not have the advantage. thanks for sharing.

my advice is always try to communicate as often and as clearly as possible on eBay. This is a lesson I am learning from work and on eBay as well. if you leave a very clear trail, then eBay will also have an easier time settling the case in the event you seek them out for help!
