ChasingHitsPokemon had a bounty on pulling the Umbreon Vmax Alt Art ($500+ raw even in Korean) which is pulled in this video then quickly put off screen before being replaced with a Leafeon Vmax

Is a bounty the same as a lottery/raffle? If so, I wonder what will happen if the victim reports this to the seller’s State. I could be wrong but in most States, online raffles and lotteries require a licence. Also, could there be an argument for fraud?

Nah they brought the banhammer down on someone in the sports world who tried something like this. I think they’ll do the same if enough people bring attention to this one.

That is so remarkably unsubtle. How blindly confident do you need be to try something so obvious on camera.

Because they have to open a pack you receive it technically avoids bounty and raffle laws. Thats how they get around it because they received the pack of cards whatnot isnt liable for games of chance because a profuct is received. Its a major loophole in the system. If the guy hadnt been a scammer he would have rdceived a 1.5k bounty worth of unopemed product. Ive won bounties on whatnot before in the early daya most people are legit on there but theres a few scumbags. Now i just go on there buying underpriced singles when people miss variations (topps chrome sparkle or japanese no rarity ect)

I’m 50/50 with your technicality argument. So the process is no longer a raffle when the participants receive their goods, even though the conduct and process up until that point was a raffle? I’m not saying you’re wrong, but it’s difficult for me to understand.

Surely a fraud charge might have a better chance of meeting the evidential threshold? Whatnot isn’t liable but the victim can still file a report and a formal statement against the alleged scammer - if he/she knows which State the alleged scammer lives in.

I’m just a simple layman. I hope a lawyer or prosecutor can chime in.

Directlu from whatnot. The fact that they allow bounties on the platform with a written no gambling policy means they dont consider bounties raffles or gambling as long as said person receives an item. Explains the lenient one week ban they received.

That makes more sense. So a fraud complaint to the correct authorities is a solid route for the victim.

The saddest thing is next week there will probably still be customers breaking with him.

The video says he was banned for a week. Im sure he will never do it again with such a harsh penalty imposed on him.

Many of the reddit posts were removed due to witch hunts and doxxing concerns but before they were, it seems the account was fully deleted or banned due to the backlash and there were already reports that the streamer made a new account that was already being reported again.

It seems like the user handled this with all the finesse of farting during a wake. Maybe they thought nobody would say anything because its so awkward…
